Old Iron Doors - Terms and Conditions
of Sale
PAYMENT TERMS:
Old Iron Doors, LLC hereinafter referred to as
OID, LLC requires a 50 % non-refundable deposit at order acceptance. No order shall be
finalized nor accepted as a finalized order until funds for an order have been
deposited into an OID, LLC Bank Account and cleared through the Institution upon
which those funds are drawn. Once a deposit for an order has cleared the
Institution upon which the funds are drawn, the deposit shall constitute
acceptance of the terms and conditions of sale as defined herein between
customer and OID, LLC. Final payment, including all freight and installation
charges shall be due three business days prior to both the product being released to a freight carrier for
shipment and to local delivery of product. All actions for collections
shall be subject to reasonable attorney’s fees and court costs. All pricing is
subject to change without notice prior to order acceptance as defined herein.

FREIGHT:
When product is placed for shipment with any
Freight Carrier, said product shall become the sole property of Buyer. Any
issue, whatsoever, in regards to product loss or damage in transit shall rest
explicitly between Buyer and Freight Carrier. OID, LLC custom crates all
products for safe job site delivery. Additional manpower or a forklift is
required. INSPECT YOUR SHIPMENT THOROUGLY WHEN IT ARRIVES. Report for loss or
damaged shipments, must be made promptly by the customer to the Freight Carrier,
not OID, LLC.
Unless otherwise agreed upon by the parties, all
orders shall be shipped prepaid, with freight and crating charges added to
invoice. Shipments will be made by the most expeditious and economical means
available to OID, LLC, unless other specific shipping instructions are
indicated.
FINAL PAYMENT shall be due prior to shipment.
Tracking information on product shipment is available upon request.
CHANGES AND CANCELLATIONS: All product
manufactured shall be considered custom. The design of a door once placed with
and accepted by OID, LLC is noted on an order form and may only be altered
relative to production schedule, and only upon terms, which will indemnify OID,
LLC against loss.
A door manufacturing order once placed with and
accepted by OID, LLC and subsequently cancelled shall be subject to deposit
forfeiture. A stocking fee not to exceed 50% of the full list price may also be
imposed at OID, LLC’s sole and absolute discretion and may be relative to time
of cancellation.
RETURNS: All product manufactured shall be
considered custom. Merchandise cannot be returned without a Return Material
Authorization (RMA). Unauthorized returns will be refused and returned to sender
at their expense. All claims for defective merchandise, billing errors, etc.
must be made in writing to OID, LLC within 7 days from date of arrival. In no
event shall any product manufactured over 66 sq. ft. in total size be authorized
for return.
WARRANTY: OID, LLC warrants all Goods against
manufacturing defects for 5 years on the product itself, 1 year on the finish,
and will repair or replace, at OID’s, LLC sole discretion, all defective Goods.
This warranty excludes installation, weather-stripping, finish weathering.
Glass, threshold, door sweeps,
locks, window locks, roller catchers, flush bolts and all other hardware
carry hardware manufacturer warranty. All product finishes may age relative to
exposure. In time finish may rub off in places due to frequency of use. OID, LLC
does not consider this to be a defect, but rather a normal process, which cannot
be avoided, and over time enhances the naturally aging appearance of the metal.
All OID, LLC iron components are hand crafted. Some designs may dictate that
slight variances occur to preserve strength and rhythm. OID, LLC reserves the
right to make minor design adjustments in the spirit of this strength of
rhythm. All product manufactured by OID, LLC is “one of a kind” and as such may
contain variations in color from any samples presented. There may also be
slight variations in form and functionality of the product that may be different
from any product inspected or viewed by customer. OID, LLC does not consider
such “variations” to be defects, but rather a natural characteristic of the
product that enhances its value and defines it as “one of a kind”. Such
“variations” include but are not limited to hardware positioning and forces
necessary to operate same, smoothness of edges on the ornamental iron designs.
OID, LLC assumes no liability for any labor
charges regarding the installation, removal or reinstallation of doors. Damages
caused by accident, misuse, abuse or improper installation are not covered by
this warranty. All disputes relating in any way to these Terms and Conditions of
Sale shall be resolved in the State of Alabama and Alabama State Law shall
govern such disputes.
SERVICE CALLS: All service calls carry an hourly
rate of 60 dollars per hour. Any items covered by existing warranty will be
credited against the service call.
Travel time from shop to location and return
shall be charge at the hourly rate of 60 dollars with a minimum of one hour
minimum.
ARBITRATION: Any dispute, controversy or claim
arising out of or in connection with this agreement will be settled by binding
arbitration in Birmingham, Alabama, United States of America in accordance with
the applicable rules for expedited review of (and by an independent arbitrator
selected by) the American Arbitration Association, and the decision of such
arbitrator, including any award of attorney’s fees and coast, may be entered
into any court with jurisdiction.
DISCLAIMER: OID, LLC makes no claim whatsoever
express or implied as to the security features of this product on the intent of
its use. Terms and conditions are subject to change at any time without prior
notice. OID, LLC shall not be responsible for changes occurring to the product
by forces exerted upon product by virtue of settling conditions which naturally
occur over time.
